Terms and Conditions of Service
Effective Date: April 2026
These Terms and Conditions (“Agreement”) constitute a legally binding contract between Sedona Plumbing and Heating (“Company”) and you, the customer. By scheduling, authorizing, or accepting services, you agree to be bound by this Agreement, which is incorporated into all estimates, invoices, and work orders.
1. Scope of Services
Sedona Plumbing and Heating provides licensed plumbing, heating, cooling, and HVAC services in Massachusetts including plumbing repairs and installations, water heater service, boiler and furnace service, heat pump installation, central air conditioning, gas line work, drain cleaning and sewer service, backflow prevention, and annual maintenance plans.
The scope of work for each job is defined in the written estimate or work order. Any additional work discovered during a service call will be quoted separately and requires your authorization before proceeding.
2. Estimates, Pricing, and Authorization
All written estimates are valid for thirty (30) days. Pricing may be adjusted if actual site conditions differ materially from those described. A signed estimate, work order, or verbal/electronic authorization constitutes approval to proceed. Emergency, after-hours, and holiday calls may be subject to additional charges disclosed prior to service.
3. Payment Terms
3.1 Payment Due Upon Completion
Full payment is due upon completion of services unless a prior written arrangement has been agreed to. We accept cash, check, and all major credit cards. For larger projects, a deposit of up to 50% may be required. In no event shall a deposit exceed one-third of the total contract price for residential home improvement contracts, as required by Massachusetts law.
3.2 Late Payment Fee
Any balance not paid within fifteen (15) days of completion is considered past due and will accrue a late payment charge of 1.5% per month (18% per annum), or the maximum rate permitted under Massachusetts law, beginning on the 16th day and accruing monthly until paid in full.
3.3 Returned Check Fee
A $35.00 returned check fee will be charged for any check returned for any reason. Payment is due within five (5) business days of notification.
3.4 Collections and Attorney’s Fees
Accounts unpaid for sixty (60) or more days may be referred to collections or legal proceedings. The prevailing party shall have the right to recover reasonable attorney’s fees, court costs, and collection expenses to the extent permitted by Massachusetts law.
3.5 Mechanic’s Lien Rights
In the event of non-payment, Sedona Plumbing and Heating reserves all rights under Massachusetts General Laws Chapter 254 to file a mechanic’s lien against the property where services were rendered.
4. MassSave Rebates
We make no representation regarding your eligibility for MassSave rebates or utility incentives. All eligibility must be confirmed by the Customer directly with MassSave prior to authorizing work.
5. Cancellations and Rescheduling
You may cancel or reschedule without charge with at least 24 hours advance notice. Late cancellations or no-shows may incur a service call fee. Cancellations after work begins may result in charges for labor, materials, and a restocking fee of up to 20% on returnable items.
6. Three-Day Right of Rescission (Massachusetts Law)
For residential contracts valued at $25.00 or more solicited at your home, you have the right to cancel within three (3) business days of signing pursuant to M.G.L. c. 93, §48. Written notice may be sent to office@sedonaplumbingandheating.com or (781) 214-0758. This right does not apply to emergency services. Deposits will be refunded within 10 business days of a valid cancellation.
7. Warranty on Labor and Materials
Labor: We warrant all workmanship against defects for one (1) year from service completion unless otherwise specified in writing. This does not cover misuse, neglect, flooding, freezing, fire, third-party modifications, or pre-existing conditions.
Parts & Equipment: All parts and equipment are covered only by the respective manufacturer’s warranty. We are not responsible for manufacturer defects.
8. Mold, Corrosion, and Hazardous Conditions
We make no representation regarding mold, fungi, bacteria, rust, corrosion, or other hazardous substances. The Company shall have no liability for losses, testing, remediation, or damages associated with such conditions. We reserve the right to cease work if hazardous conditions are discovered until they are remediated.
9. Limitation of Liability
Our liability for damage caused directly by our negligence shall not exceed the total amount paid for the specific service. We are not liable for indirect, incidental, consequential, or punitive damages, or damage caused by pre-existing conditions or concealed defects.
10. Force Majeure
We shall not be liable for delays or failures to perform resulting from causes beyond our reasonable control, including acts of God, fire, flood, severe weather, governmental action, labor disputes, or supply chain disruption.
11. Permits and Code Compliance
Where required, the Company will obtain necessary permits. Permit costs are the Customer’s responsibility. All work is performed in compliance with the Massachusetts State Plumbing Code (248 CMR), the Massachusetts Fuel Gas Code, and applicable HVAC and building regulations.
12. Plumbing Corporation Registration
Sedona Plumbing and Heating operates as a licensed plumbing corporation in the Commonwealth of Massachusetts under Corporation No. PL-C-9628938. All plumbing work is performed by or under the direct supervision of a licensed Master Plumber in compliance with M.G.L. c. 142 and 248 CMR. This Agreement, together with the associated written estimate or work order, constitutes the written contract required under applicable Massachusetts law.
13. Customer Responsibilities
- Provide safe, clear access to the work area and utilities at the scheduled service time.
- Disclose any known hazards, prior repairs, existing conditions, or modifications before work begins.
- Ensure an adult (18+) is present at the property during all service visits.
- Secure pets away from work areas.
- Contact us directly to address any concerns before posting any online review or public complaint.
14. Dispute Resolution and Arbitration
In the event of a dispute, the Customer agrees to first contact us at (781) 214-0758 or office@sedonaplumbingandheating.com. If not resolved within 30 days, the parties agree to mediation under the American Arbitration Association (AAA). Unresolved disputes shall be settled by binding AAA arbitration under Construction Industry Arbitration Rules. This Agreement is governed by the laws of the Commonwealth of Massachusetts.
15. Text Message Consent
By providing your mobile phone number, you consent to receive SMS/MMS messages regarding appointments, dispatch, invoices, and payment reminders. Message and data rates may apply.
